Terms & Conditions – Selling Your Device to Us
Please read these Terms and Conditions carefully before submitting any mobile phone, tablet, laptop, iPad, smartwatch, games console or other electronic device to us for a quotation or offer.
By submitting your device to us, you agree to be bound by these Terms and Conditions. No contract for sale is formed until we have inspected the device, confirmed the final offer, and accepted the purchase.

The Phone Shop is operated by Phone Orbit LTD, registered in England and Wales under company number 08087307, with registered office at The Phone Shop 93 Chester Road Sunderland SR4 7EZ.
1. Definitions
In these Terms:
“We”, “us” or “our” means The Phone Shop Sunderland / Phone Orbit LTD.
“You” or “your” means the person submitting a device to us.
“Device” or “Equipment” means any mobile phone, tablet, laptop, iPad, smartwatch, games console or other electronic item submitted to us.
“Quotation” means the estimated price we provide before or after inspecting the device.
“Final Offer” means the confirmed price offered after inspection.
“Contract” means the agreement between you and us for the sale of your device.
These Terms apply to consumer sellers only.
2. How the Selling Process Works
2.1 When you submit details of your device to us, we may provide an initial quotation based on the information you provide.
2.2 Any initial quotation is not a binding offer. It is an estimate only and may change after inspection.
2.3 Once we receive or inspect the device, we will assess its condition, including but not limited to:
- make and model
- storage capacity
- network status
- cosmetic condition
- screen condition
- battery health
- charging function
- camera function
- buttons
- software locks
- iCloud, Google, Samsung or other account locks
- blacklist, lost or stolen status
- finance or contract status
- liquid damage
- internal faults
2.4 After inspection, we may:
- confirm the original quotation
- make a revised offer
- reject the device
- request further information from you
2.5 A contract is only formed when:
- we make a final offer;
- you accept that final offer; and
- we confirm acceptance and process payment.
2.6 We reserve the right to refuse to purchase any device at our sole discretion.
3. Condition and Inspection
3.1 Devices must match the description provided by you.
3.2 If the device differs from the information supplied, we may reduce the offer or reject the device.
3.3 We may need to open or test the device to assess faults, parts, battery condition, previous repair work, water damage or internal issues.
3.4 If we cannot safely inspect the device without risk of damage, we may contact you for permission before proceeding.
3.5 Our decision on condition, grading and valuation is final.
4. Pricing and Offers
4.1 The price payable will be the final offer agreed after inspection.
4.2 Initial quotations may change if:
- the condition is worse than described
- parts are missing
- the device is locked
- the battery is failing
- the screen is damaged
- the housing is damaged
- the device has been repaired before
- the device is financed, barred, blacklisted or reported lost/stolen
- faults are found during testing
4.3 New or sealed devices must be fully paid off, legally owned by you, and free from finance, contract, insurance claim, hire purchase or any third-party ownership.
4.4 If a device is under finance or contract, we may refuse it or offer a reduced price.
5. Payment
5.1 Payment will usually be made once the final offer has been accepted.
5.2 Payment may be made by bank transfer, cash or another method agreed by us.
5.3 You are responsible for ensuring any bank details provided are correct.
5.4 We are not liable for payment delays or losses caused by incorrect details supplied by you.
5.5 Any applicable VAT is included in the agreed purchase price.
6. Ownership and Legal Title
6.1 You confirm that:
- you are the legal owner of the device;
- you have the right to sell the device;
- the device is not stolen;
- the device is not subject to an insurance claim;
- the device is not subject to finance unless disclosed;
- the device is not barred, blacklisted or reported lost.
6.2 You must be aged 18 or over and resident in the United Kingdom.
6.3 We may request proof of identity, proof of address, proof of purchase or ownership evidence.
6.4 Ownership of the device passes to us once payment has been made.
7. Lost, Stolen, Blocked or Financed Devices
7.1 We may check devices against lost, stolen, barred or blacklisted databases.
7.2 If a device is flagged as lost, stolen, barred, blacklisted, financed or subject to ownership dispute, we may:
- suspend the transaction
- withhold payment
- request further proof of ownership
- report the matter to relevant authorities
- retain the device where legally required
- return the device where appropriate
- cancel the transaction
7.3 If payment has already been made and the device is later found to be stolen, blacklisted, financed or not legally yours to sell, you agree to repay the full amount immediately.
7.4 We may provide your details to law enforcement, insurers, mobile networks or relevant third parties for fraud prevention and crime prevention purposes.
8. Your Responsibilities Before Selling
Before submitting your device, you must:
- remove all personal data
- back up your data
- remove SIM cards
- remove memory cards
- remove iCloud, Google, Samsung or other account locks
- disable Find My iPhone or similar tracking services
- cancel airtime contracts
- disclose any faults, finance, insurance claims or ownership issues
8.2 We are not responsible for any loss of data.
8.3 We may wipe, reset or erase a device during testing or processing.
8.4 You are solely responsible for ensuring your data has been backed up before handing the device to us.
9. Locked Devices
9.1 Devices must be free from passwords, PINs, iCloud locks, Google locks, Samsung locks, MDM locks or any other security restrictions.
9.2 If a device is locked, we may contact you for assistance.
9.3 If the lock cannot be removed, we may reduce the offer, reject the device or return it to you.
10. Delivery and In-Store Drop Off
10.1 You may bring your device to us in store at:

10.2 If posting a device to us, you are responsible for safe packaging and using an appropriate tracked and insured postal service.
10.3 We are not responsible for devices lost or damaged in transit before they arrive with us.
10.4 If we return a device to you, risk passes back to you once it is delivered to your address or collected by you.
11. Rejected or Revised Offers
11.1 If we revise an offer after inspection, you may accept or reject the revised offer.
11.2 If you reject the revised offer, we will return the device or make it available for collection.
11.3 If you do not respond within a reasonable period, we may hold the device until you contact us.
11.4 Storage fees may apply if a device is left uncollected for an extended period after notice has been given.
12. Limitation of Liability
12.1 Our total liability shall not exceed the agreed purchase price of the device.
12.2 We are not liable for:
- loss of data
- loss of use
- indirect losses
- consequential losses
- loss of profit
- loss caused by incorrect information supplied by you
- loss caused by third-party delivery services
12.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded.
13. Privacy and Data
13.1 We may process your personal information for the purpose of:
- providing quotations
- purchasing devices
- verifying ownership
- preventing fraud
- complying with legal obligations
- contacting you about your transaction
13.2 Your information may be shared with law enforcement, insurers, mobile networks or fraud prevention agencies where necessary.

14. Force Majeure
We are not liable for delays or failure to perform our obligations due to events outside our reasonable control, including postal delays, system failures, power failures, strikes, severe weather, legal restrictions or other events beyond our control.
15. Governing Law
These Terms and any dispute arising from them shall be governed by the laws of England and Wales.
The courts of England and Wales shall have jurisdiction over any dispute.
